TRADEMARKS

A trademark is a type of intellectual property consisting of a recognizable sign, design, or expression which identifies products or services of a particular source from those of others. The trademark owner can be an individual, business organization, or any legal entity. A trademark may be located on a package, a label, a voucher, or on the product itself. In an easy language Your trademark registration gives an exclusive right: no one else has the right to use the trademark for their products or services, or in their marketing.
Note:- A trademark application can be made by Private Firms, Individuals, Companies, NGO’s.

Types of Trademarks Includes:-

  • Product Trademarks:- These are those marks that relate to goods.
  • Service Trademarks:- It is used to identify the services rendered by an organization from others.
  • Collective Trademarks:- They are registered in the name of groups, associations or other organizations which indicate the membership of group for the purpose of involvement and utilisation of members of the group in their commercial activities. However, such marks are not so popular.
  • Certification Trademarks:- These are those which distinguish the goods or services in connection with the course of trade and which are certified by the proprietor in respect of their material, origin, quality, manufacturing methodology and specific features
  • Textile Trademarks:- Textile mark is a trademark used in textile goods.
  • Other Trademarks:- Enterprise Trademarks, Series Trademarks, Associate Trademarks, Shape Trademarks, Sound Trademarks.

Features of Trademarks :-

  • Customers identify a product by its trade mark.
  • Trade mark is property of the company.
  • The function of trade mark is to give an indication to the purchaser regarding the manufacture and quality of the goods.
  • It is an intangible asset which can be sold and assigned.
  • The value of trade mark increases as the business grows.
  • The main reason of the foundation of such rights is: the principle that no one is entitled to represent his business or goods as being the business of another.
  • A registered trademark owner has the legal right in case of infringement
  • A product or service being sold under a registered trademark assists in developing up trust, safety, quality, and goodwill in the minds of customers. It gives you a unique identity when linked to other sellers.
  • A trademark which is registered and filed in India is permitted to be filed in other countries outside India as well. Moreover, foreigners can also get a trademark registered and filed in India.

Individuals & Sole Proprietorship:-

  • Copy of the logo, preferably in black & white (Optional). In case the logo is not provided, the trademark application can be filed for the word.
  • Signed Form-48. Form-48 is an authorisation from the applicant to a Trademark Attorney for filing the trademark application on his/her behalf.
  • Identity Proof of the individual or Proprietor.
  • Address Proof of the individual or Proprietor.

Partnership / LLP / Company:-

  • Copy of Logo (Optional)
  • Signed Form-48.
  • Udyog Aadhar Registration Certificate.
  • Incorporation Certificate or Partnership Deed.
  • Identity Proof of Signatory.
  • Address Proof of Signatory.

Other Applicants:-

  • Copy of Logo (Optional)
  • Signed Form-48.
  • Incorporation Certificate or Partnership Deed.
  • Identity Proof of Signatory.
  • Address Proof of Signatory.

Validity of a trademarks :-

  • At the end of the validity of a trademark, a trademark can be renewed simply by giving the Government fee for registration within 6 months by Form TM-12 Renewal of Registration from the date of expiry of the trademark.
  • An expired trademark can be renewed through Form TM-13 (Restoration & Renewal) after 6 months and within 1year from the expiration of the last registration of the trademark.

Compliances:-

The procedure for recordable of assignment is contained in Section 45. An application to register the title of a person who becomes entitled by assignment to a registered trademark should be made together with the prescribed fee.
